These Terms, including our Privacy Policy, form the entire agreement (“Agreement”) between you ("you") and Kids First Urgent Care. By accessing or using the Service, you represent that you have read, understand, and agree to be bound by these Terms. If you do not agree, do not access or use the Service.

ARBITRATION NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER. BY USING THE SERVICE, YOU AGREE THAT DISPUTES BETWEEN YOU AND KIDS FIRST URGENT CARE WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION AND YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Some healthcare providers may pay a fee to be listed or to offer appointment scheduling through the Service. We do not recommend or endorse any particular healthcare provider. Provider listings are for your convenience only.
Appointment Availability
Appointment availability is subject to change without notice. We do not guarantee that any healthcare provider will be available when you attempt to schedule, and we are not liable for any changes or cancellations by providers.
Payments
If the Service allows you to make payments for certain products or services, you authorize us or our payment processors to charge your chosen payment method. All payment terms will be presented to you at the time of purchase. We are not responsible for issues related to your payment method.

TO THE FULLEST EXTENT PERMITTED BY LAW, KIDS FIRST URGENT CARE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE. YOUR SOLE REMEDY IS TO STOP USING THE SERVICE.
Health Care Services Disclaimer
Kids First Urgent Care is not a healthcare provider and does not provide medical advice. Any healthcare services you receive via the Service are provided by independent healthcare professionals who are solely responsible for such services. We do not control or influence healthcare providers’ professional judgment.
Indemnification
You agree to indemnify, defend, and hold harmless Kids First Urgent Care and its affiliates, officers, directors, employees, and agents from any claims arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.
Arbitration Agreement; Class Waiver
Any dispute arising from these Terms or your use of the Service will be resolved by binding arbitration on an individual basis, administered in Miami, Florida. You waive the right to a jury trial or to participate in a class action. The Federal Arbitration Act and Florida law will govern interpretation and enforcement of this provision.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Except for disputes subject to arbitration, you agree to submit to the exclusive jurisdiction of the state or federal courts located in Miami, Florida.
Assignment
We may assign our rights and delegate our obligations under these Terms without notice to you. You may not assign your rights under these Terms without our prior written consent.

These Terms do not create any rights or benefits in favor of any third party.
